Terms of Service

These Terms govern your use of Materna. By using the platform you agree to them. Materna is intended to support, not replace, professional medical judgment, and is not a substitute for emergency care. If you are experiencing a medical emergency, call 911.

Accounts

Patient accounts are free. We will never charge a patient to access their own record or to use safety, voice, or care-coordination features.

Provider, facility, payer, and coordinator accounts are governed by a separate written master services agreement.

You agree not to share login credentials or attempt to access accounts that are not yours.

Acceptable use

Do not upload content that is unlawful, defamatory, or that violates the privacy of another person.

Do not attempt to circumvent security controls, perform vulnerability testing without written authorization, or scrape PHI.

Use the voice features only for yourself or for someone for whom you have legal authority (for example, a minor child).

Telehealth and clinical advice

AI Scribe drafts and Voice Companion suggestions are not medical advice. Your assigned clinician reviews and signs the chart.

Voice triage and risk scoring assist your care team. They do not replace it.

In a critical-safety event the platform shows emergency contacts (988, 911, your facility) and creates an alert. Acting on those numbers is your decision.

Disclaimers and liability

The platform is provided "as is" without warranties of merchantability or fitness for a particular purpose.

To the maximum extent permitted by law, our aggregate liability for any claim is limited to fees paid by your facility for the relevant period.

Nothing in these Terms limits liability for fraud, willful misconduct, or HIPAA noncompliance.

Termination

You may terminate your account at any time. We will retain records as required by law (for example, 6-year HIPAA retention for audit logs).

We may suspend an account for material breach, after notice and an opportunity to cure, except where doing so would risk patient safety.
